These Terms of Service and Sale govern the use of www.CarlJosephArt.com and purchases from Carl Joseph Art. By using this website or completing a purchase, you agree to these terms.

  1. BUSINESS INFORMATION

This website is operated by Carl Joseph Art and artist Carl Joseph.

  1. ELIGIBILITY

You must be legally capable of entering into a binding agreement to place an order. You agree to provide current, complete and accurate billing, delivery and contact information.

  1. ARTWORK AND PRODUCT INFORMATION

We make reasonable efforts to describe products accurately. Because screens, lighting and photography differ, displayed colors may vary from the physical artwork.

Dimensions are approximate unless explicitly guaranteed. Handmade artwork may contain texture, visible brushwork, surface variation and other characteristics of the artist’s process. These characteristics are not defects.

Interior mockups are provided to demonstrate scale or presentation and may not show exact proportions. Product specifications on the written listing control.

  1. ORIGINAL ARTWORK

Unless otherwise stated, an original artwork is a physical, one-of-one object.

Purchasing an original artwork transfers ownership of the physical object only. Copyright and all reproduction, publication, licensing, merchandising and other intellectual-property rights remain with Carl Joseph unless transferred through a separate written agreement.

The purchaser may display and resell the physical artwork but may not reproduce, commercially exploit or create derivative products from the artwork without written permission.

  1. AVAILABILITY

Placing an item in a cart does not reserve it. Because original artwork is one of one, an item may become unavailable before checkout is completed.

If the same original artwork is purchased through more than one channel, Carl Joseph Art may cancel the later transaction and issue a refund to the original payment method.

  1. PRICES, TAXES AND PAYMENT

Prices are displayed in U.S. dollars unless otherwise indicated.

Applicable taxes, shipping, delivery, crating, customs duties or installation fees may be added as disclosed during checkout or in a written invoice.

Payment must clear before an order is shipped, delivered or released.

Available installment-payment services are provided by independent payment companies and are subject to their own approval processes and terms.

  1. ORDER ACCEPTANCE

An automated order confirmation acknowledges that an order was received. It does not guarantee final acceptance.

Carl Joseph Art may decline or cancel an order because of product unavailability, suspected fraud, payment problems, incorrect pricing, listing errors, delivery limitations or other legitimate business reasons.

If a paid order is canceled by Carl Joseph Art, the appropriate payment will be refunded to the original payment method.

  1. SHIPPING AND DELIVERY

Shipping and delivery are governed by the Shipping and Delivery Policy.

Oversized or high-value artwork may require a separate delivery quote, custom crating, insured transportation, scheduled delivery or special handling.

Customers are responsible for providing accurate delivery and access information.

  1. RETURNS, REFUNDS AND DAMAGE

Returns and refunds are governed by the Returns, Exchanges and Refunds Policy.

Shipping damage is governed by the Damage in Transit Policy.

One-of-one originals, commissions and personalized products may be final sale except when damaged, incorrectly fulfilled, materially misdescribed or otherwise returnable under applicable law.

  1. COMMISSIONED ARTWORK

Commission projects may require a separate signed agreement covering the concept, dimensions, price, deposit, payment schedule, revisions, completion estimate, delivery and intellectual-property rights.

If a commission agreement conflicts with these website terms, the signed commission agreement controls for that project.

  1. INTELLECTUAL PROPERTY

All artwork, photographs, videos, text, branding, designs, logos and website content owned by Carl Joseph Art are protected by applicable copyright, trademark and other laws.

Website content may not be copied, reproduced, distributed, modified, sold, used to train a commercial system, placed on merchandise or used commercially without written permission, except where applicable law permits otherwise.

Sharing a direct website or social-media link for noncommercial purposes is permitted.

  1. ACCEPTABLE WEBSITE USE

You may not use this website to:

• Violate applicable law
• Commit or attempt fraud
• Interfere with website security
• Introduce malicious software
• Collect information about other users without authorization
• Misrepresent your identity
• Infringe intellectual-property rights
• Resell website content or images without permission

  1. THIRD-PARTY SERVICES

The website may use or link to third-party services, including Shopify, payment processors, shipping companies and social-media platforms.

Those services operate under their own terms and privacy practices. Carl Joseph Art is not responsible for third-party websites or services outside its reasonable control.

  1. WEBSITE ERRORS

We reserve the right to correct typographical errors, inaccurate descriptions, incorrect pricing or availability information.

When a correction materially affects a pending order, the customer will be notified and given an appropriate opportunity to approve the correction or cancel the order.

  1. CARE AND INSTALLATION

Customers are responsible for safely displaying and maintaining purchased artwork after delivery.

Unless expressly included in writing, the purchase price does not include professional installation. Carl Joseph Art is not responsible for damage caused by improper installation, unsuitable hardware, environmental conditions, direct sunlight, moisture, extreme temperature or improper cleaning after successful delivery.

  1. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Carl Joseph Art will not be responsible for indirect or consequential losses arising from the use of this website or a product.

Nothing in these terms excludes liability or consumer rights that cannot legally be excluded.

  1. GOVERNING LAW

These terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.

  1. SEVERABILITY

If any provision of these terms is found unenforceable, the remaining provisions will remain in effect.

  1. CHANGES TO THESE TERMS

These terms may be updated periodically. The effective date at the top identifies the latest version. Changes apply prospectively unless applicable law requires otherwise.
